Appeals Court Orders Re-Sentencing

The federal appeals court has ruled that the original 14-year sentence imposed on Michael Avenatti needs reevaluation. The court criticized the sentence for being excessively influenced by a perjury enhancement without ample consideration of Avenatti’s professional contributions and efforts to repay restitution to his defrauded clients.

Michael Avenatti gained notoriety during his representation of Stormy Daniels in her legal case against former President Donald Trump. Despite his fame, he later faced legal challenges himself, pleading guilty to four counts of wire fraud and one tax charge in 2022, without a plea bargain. Now, he finds himself back in court, pending re-sentencing.

Financial Misconduct and Its Consequences

Avenatti’s previous convictions for aggravated identity theft and the attempted extortion of Nike hang heavy in the balance. The court ordered a reassessment of whether these additional sentences should proceed concurrently with the upcoming re-sentencing. His legal journey is far from over as the trial court is tasked with addressing these serious allegations.

Commenting on the ruling, the appellate judges noted, “Avenatti contends that (Selna) should have accounted for the value of his legal services and costs, as well as the value of certain payments he made to victims. The trial court must also evaluate whether Avenatti received fair credit for his legal services, expenses, and any payments made to his clients. The court’s decision will directly influence the new terms of his sentence, potentially resulting in a reduced prison term.

The case has been assigned to United States District Judge James V. Selna for reconsideration. A decision on whether Avenatti’s other sentences will run concurrently with the new sentence is anticipated. The reassessment raises questions about the implications of his initial sentencing, which prosecutors claimed was inflated by a perjury enhancement.
